Terms of Use

These Terms of Use ("Terms") govern your access to and use of the SelectiveFill service ("Service"), including the SelectiveFill plugin for Adobe Photoshop, the website at selectivefill.com, and the SelectiveFill API. The Service is operated by LMF SAS, a French company registered under SIREN 838 953 479 ("we", "us", "our").

By creating an account, purchasing credits, or using the Service, you agree to these Terms.

1. The Service

SelectiveFill is an AI-powered image generation and editing tool that operates as a plugin within Adobe Photoshop. The Service uses third-party AI models to generate or modify images based on your inputs (source images, reference images, and text prompts).

When you submit a generation request, your inputs are transmitted to our servers. Reference images may be preprocessed on our servers (for example, cropping, resizing, and format conversion) before being forwarded to one or more third-party AI model providers for processing. The providers currently include Google (Gemini API), Freepik, and Recraft. We may add or change providers; material changes will be reflected in our Privacy Policy.

2. Your Account

You must be at least 16 years old to use the Service. You are responsible for maintaining the security of your account and for all activity under your account.

3. Credits and Payment

The Service operates on a credit-based system. Credits are purchased through our payment processor, Stripe.

Credit balances do not expire while your account remains active. Unused credits are not refundable except as required by applicable law. Credit prices and allocations are as published on our pricing page at the time of purchase.

Subscriptions: Paid subscriptions renew automatically at the end of each billing period (monthly or annual). We will notify you before each renewal. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. Unused credits from a cancelled subscription remain available until your account is closed.

Top-ups: One-time credit purchases ("top-ups") are available to active subscribers and are non-refundable once delivered.

4. Right of Withdrawal (EU/EEA Consumers)

Under EU consumer protection law, you have a 14-day right to withdraw from distance contracts without giving a reason.

However, by purchasing credits or a subscription on SelectiveFill, you expressly agree that:

  1. credits and digital content are delivered to your account immediately upon purchase;
  2. you acknowledge that you lose your right of withdrawal once delivery has begun.

This waiver is presented and must be accepted at checkout before your purchase is processed. If we fail to present this waiver, you retain your full 14-day right of withdrawal.

If you are entitled to withdraw, we will refund all sums paid within 14 days of receiving your withdrawal notice.

5. Your Content and Inputs

You retain all ownership rights in the images and other content you upload to the Service ("Your Content"). We do not claim ownership of Your Content.

By using the Service, you grant us a limited, non-exclusive, worldwide licence to process, transmit, and temporarily store Your Content solely for the purpose of providing the Service to you. This licence terminates when we delete Your Content from our systems.

You represent and warrant that:

  1. you have all necessary rights, permissions, licences, and authorizations for all content you upload, including intellectual property rights, image rights, and any required consent from identifiable individuals;
  2. your use of the Service does not violate any agreement you are party to, including non-disclosure agreements, employment contracts, or client confidentiality obligations;
  3. you are authorized to disclose any uploaded content to SelectiveFill and its third-party AI sub-processors.

If you upload content that is subject to a non-disclosure agreement, client confidentiality, trade secret protection, or similar restrictions, you are solely responsible for ensuring that your use of the Service is permitted under those restrictions. The Service transmits your content to third-party AI providers, which constitutes a disclosure to those providers.

6. AI-Generated Outputs

The Service uses third-party AI models to generate outputs. You acknowledge that:

  1. outputs are generated by AI and may contain errors, distortions, artefacts, or undesired content;
  2. we do not guarantee that outputs are accurate, lawful, non-infringing, original, unique, or fit for any particular purpose;
  3. the legal status of AI-generated content, including copyright ownership, varies by jurisdiction and is not settled in many territories;
  4. you are solely responsible for reviewing all outputs before any commercial, public, or professional use;
  5. you must independently verify that your use of outputs does not infringe the rights of any third party.

We do not claim ownership of outputs generated through the Service. Your rights in outputs are subject to the terms of the underlying AI model providers and applicable law.

7. Acceptable Use

You must not use the Service to:

  1. generate, attempt to generate, or distribute child sexual abuse material or any sexual content involving minors;
  2. generate non-consensual intimate imagery of any person;
  3. create deepfakes or manipulated media intended to deceive, defraud, or harass;
  4. impersonate a specific real person without their consent;
  5. generate content that constitutes harassment, threats, incitement to violence, or hate speech;
  6. infringe the intellectual property rights, image rights, or privacy rights of any third party;
  7. violate any applicable law or regulation;
  8. attempt to reverse-engineer, extract, or retrain models through the Service;
  9. use the Service through automated means (bots, scrapers) except through our official API with valid authentication.

We reserve the right to suspend or terminate your account immediately and without refund for any violation of this section. We may also report violations to law enforcement where required or appropriate.

8. Reporting and Moderation

If you become aware of content generated through the Service that violates these Terms or applicable law, please report it to abuse@selectivefill.com. We will investigate reports promptly and take appropriate action.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. the Service is provided "as is" and "as available" without warranties of any kind, express or implied;
  2. our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim;
  3. we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law, including the French legal guarantee of conformity for digital services.

10. Digital Service Conformity Guarantee (EU/EEA Consumers)

If you are a consumer in the EU/EEA, the Service is subject to the legal guarantee of conformity for digital services under the French Consumer Code (Articles L224-25-12 et seq.). This guarantee covers defects in the Service itself (e.g., the Service fails to function as described) and applies for two years from delivery for one-off supplies, or for the duration of continuous supply. This guarantee does not cover the quality, accuracy, or suitability of AI-generated outputs, which are inherently variable.

11. Third-Party Services

The Service relies on third-party AI model providers. We are not responsible for the availability, performance, or policies of these providers. If a provider becomes unavailable, we will use reasonable efforts to restore service or offer an alternative, but we do not guarantee uninterrupted access to any specific model.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes arising from or relating to these Terms shall be submitted to the competent courts of Paris, France, subject to any mandatory consumer protection provisions that grant jurisdiction to the courts of the consumer's place of residence.
